Article 1. General
1.1. In these terms and conditions, the term client means any natural person or legal entity that commissions Topito’s to provide services and/or deliver goods.
1.2. Changes to these terms are only valid if made in writing and apply only to the specific agreement. All other terms remain in effect.
1.3. If any part of these terms is void or invalid, the rest remains enforceable. The parties will agree on a replacement clause that closely matches the original intent.
1.4. The client’s terms apply only if Topito’s agrees to them in writing.
1.5. These terms and conditions apply to all catering services provided by Topito’s.
1.6. By placing an order, the client agrees to be bound by these Terms and Conditions.
1.7. Topito’s reserves the right to amend these Terms at any time. Updates will be posted on the website.
Article 2. Ordering & Booking
2.1. Orders must be placed at least 48 hours in advance via our website.
2.2. Catering services (delivery and on-site) are available between 11:00 and 20:00 from Friday to Saturday, unless otherwise agreed in writing.
2.3. The date and time of the service must be specified by the client when ordering online.
2.4. Our catering services are available exclusively within Eindhoven and surrounding areas, including but not limited to Veldhoven, Geldrop, Nuenen, Best, Waalre, and Son en Breugel. Service outside this area may be considered upon request and may incur additional charges.
2.5. Minimum and maximum number of guests:
– Playa Chica: 10 to 29
– Playa Grande: 30 to 100
2.6. Currently, we are unable to serve more than 100 guests.
2.7. All packages include a standard selection from our menu, consisting of 4 options of tostadas and 2 options of aguas frescas.
2.8. Each guest receives 2 tostadas and 1 agua fresca.
2.9. Custom menu options may be accommodated upon request, subject to availability.
Article 3. Prices & Taxes
3.1. Prices vary per catering package and type of service:
– Playa Chica: €12 per person (delivery only)
– Playa Grande: €11 per person (delivery only) and €13 per person (on-site service)
3.2. All prices exclude sales tax (VAT) imposed by the government. VAT rates vary by type of service:
– Playa Chica and Playa Grande delivery only: 9% VAT
– Playa Grande on-site service: 21% VAT
3.3. Price increases resulting from changes and/or additions to the order by the client shall be borne by the client.
3.4. The client may adjust the number of guests or services up to 4 days before the event, with a maximum change of 10%.
3.5. Shipping is included in the price for locations specified in Article 2.4.
Article 4. Payments
4.1. Full payment is required at the time of booking via the online shop.
4.2. A confirmation email will be sent upon successful payment.
4.3. An invoice will be sent upon successful payment.
4.4. Current payment options include iDEAL, PayPal, VISA, Mastercard, American Express, and Discover.
Article 5. Cancellations & Refunds
5.1. Cancellations must be made at least 48 hours before the delivery date for a full refund.
5.2. Cancellations made at least 24 hours before the delivery date qualify for a 50% refund.
5.3. Cancellations made less than 24 hours before the event are non-refundable.
5.4. Refunds will be processed using the original payment method within 7 working days.
5.5. Cancellations must be submitted in writing. The calculation of any amount payable is based on the date the written cancellation is received by Topito’s. No rights may be derived from verbal cancellations.
Article 6. Delivery Options (Have It Delivered)
6.1. For Playa Grande and Playa Chica delivery options, Topito’s chooses the transport method unless otherwise agreed. The client must ensure quick unloading and is responsible for proper storage.
6.2. Delivery will take place on the date and time selected by the client.
6.3. If delivery is delayed due to the client, Topito’s may charge extra costs based on the hourly (incl. VAT) rate of staff.
Article 7. Service On-Site Option (Let Us Take Care of Everything)
7.1. For Playa Grande with on-site service, Topito’s will provide serving staff and setup.
7.2. On-site services will be performed at the date and time selected by the client for a maximum of 2 hours, unless otherwise agreed in writing.
7.3. The client guarantees Topito’s timely access to all required areas and ensures the location is ready so work can proceed smoothly and without delays.
7.4. If service performance is delayed due to the client, Topito’s may charge extra costs based on the hourly (incl. VAT) rate of staff.
7.5. The client shall provide necessary facilities, such as water and electricity, free of charge unless otherwise stated in the agreement.
7.6. Topito’s bases its services on the event details provided by the client, who must supply all relevant and requested information. The client guarantees that this information is complete and accurate.
Article 8. Dietary, Allergies & Food Safety
8.1. All dishes are made with fresh and locally sourced ingredients.
8.2. Allergen information for our dishes is published on our website.
8.3. Clients must inform Topito’s of any allergies or dietary restrictions at the time of booking.
8.4. All products are sourced, stored, produced, and served under HACCP standards to ensure maximum food safety.
Article 9. Quality Warranty
9.1. The client is obliged to examine the delivered goods or services immediately for agreed quality and quantity.
9.2. Complaints about food or drinks must be reported within 2 hours of delivery or service, provided that the goods are stored and handled in accordance with Topito’s instructions.
9.3. Complaints are void if storage and handling instructions were not followed.
9.4. Other defects must be reported in writing within 3 working days, clearly described. The client must allow Topito’s to investigate the complaint.
9.5. Timely complaints do not suspend the client’s payment obligation. The client remains obliged to accept and pay for other goods delivered and/or services to be provided.
Article 10. Liability
10.1. Topito’s is not liable for any damages or losses resulting from delays, cancellations, or service interruptions beyond its control.
10.2. Clients are responsible for the safety and supervision of guests during the event.
10.3. Topito’s is not liable for damage caused by incorrect or incomplete information from the client.
10.4. If liable, Topito’s responsibility is limited to twice the invoice amount.
10.5. Liability is in any case limited to the amount covered by insurance.
10.6. The client is considered the user of the space and is liable for any damage caused during use by their guests, animals, or belongings. Topito’s is not liable and is indemnified against third-party claims.
10.7. All non-consumable items (glassware, crockery, linen, etc.) remain Topito’s property and must be returned. Damage or loss will be charged to the client.
Article 11. Force Majeure
11.1. Force majeure means unforeseen events that make it impossible or difficult for Topito’s to fulfill the agreement, without fault on its part.
11.2. This includes issues with third parties, weather, strikes, power failures, supplier delays, or client-related problems.
11.3. Both parties must inform each other promptly if they cannot meet obligations due to such events.
Article 12. Governing Law
12.1. These Terms are governed by the laws of the Netherlands.
12.2. Any disputes will be settled by the competent court in Eindhoven.
